En un nuevo precedente histórico en la lucha por el respeto y la protección de los derechos de los pueblos indígenas, el Juez Segundo de lo Penal de Pastaza, Doctor Ismael Rodríguez, sobreseyó definitivamente, a los Dirigentes de la Federación Interprovincial de la Nacionalidad Achuar (FINAE) Santiago Kawarim, Domingo Peas, Toribio Freire, entre otros y a los Dirigentes de Sarayaku Marlon Santi, Franco Viteri y José Gualinga, en la denuncia presentada por el Representante Legal de la Compañía CGC, contratista del Bloque 23, en la amazonía ecuatoriana, conjuntamente con la Compañía Burlington.
Para Milton Callera, Presidente de la FINAE, el fallo judicial “ es una muestra más de que estamos defendiendo los derechos que nos corresponden ancestralmente y que estamos defendiendo a la humanidad frente a la manipulación que quieren dar mal intencionados interese económicos”
En la Audiencia Pública Preliminar, efectuada el pasado 20 de febrero, mientras José Serrano, uno de los Abogados del Centro de Derechos Económicos y Sociales (CDES) y patrocinadores de los dirigentes en mención, rechazaban la persecución asumida por el Agente Fiscal de la causa, Abogado Gil Avilés en contra de los dirigentes y de los pueblos indígenas, Mario Melo, Abogado también del CDES y de los Dirigentes, denunciaba la intención de criminalizar la protesta social y específicamente de la lucha por la reinvidicación de los derechos colectivos, por parte de las autoridades gubernamentales y de la Fiscalía.
La defensa demostró la inexistencia del supuesto delito, ya que los argumentos del Agente Fiscal Avilés estuvieron dados por simples versiones de testigos contradictorias entre sí, a pesar de tener formatos idénticos.
Finalmente, Marlon Santi, Presidente de Saryaku indicó que “la Justicia nos está dando la razón, no nos van a amedrentar, no nos van a comprar, porque no es cuestión de dinero, para nosotros están en juego nuestras vidas”.

In a new historical precedent in the struggle for the respect for and protection of the rights of the indigenous peoples, the second judge of Pastaza, Doctor Ismael Rodríguez, definitively dismissed the charges against the board members of the Interprovincial Federation of the Achuar Nationality (FINAE), Santiago Kawarim, Domingo Peas, Toribio Freire, and others, as well as the Sarayaku leaders Marlon Santi, Franco Viteri and José Gualinga. The charges were filed based on a complaint presented by the legal representative of the CGC company, together with the Burlington company.
For Milton Callera, president of the FINAE, this judicial ruling "is one more proof of that we are defending the rights that correspond to us since time immemorial, and that we are defending humanity against the manipulations that economic interests with bad intentions are trying to carry out".
During the preliminary public audience, carried out on February 20, José Serrano, one of the lawyers of the Centro de Derechos Económicos y Sociales (CDES), and defense councel of the forementioned leaders, rejected the persecution carried out by the prosecutor of the case, Gil Avilés, against the indigenous peoples and their leaders. On the other hand, Mario Melo, also of CDES and defense councel of the leaders, denounced the intention of the governmental authorities and the public prosecutor to criminalize social protest and in particular the struggle for collective rights.
The defense showed the inexistence of the supposed crime, as the arguments of the prosecutor Avilés were provided by simple versions of witnesses, which were mutually contradictory in spite of having identical formats.
Finally, Marlon Santi, president of Sarayaku, indicated that "the Justice is giving us right, they will not be able to scare us, they will not be able to buy us, because this is not a matter of money, for us our lives are at stake".
